RIGHT OF WITHDRAWAL

According to the Consumer Code, subject to certain exceptions, the consumer customer who makes a purchase at a distance (and therefore also on our website) or negotiated off-premises, has the right to terminate the purchase contract without having to provide any reason by giving notice within 14 calendar days of receipt of goods.

The right of withdrawal is not exercisable by professional customers and / or companies with VAT.

APPLICABLE LEGISLATION AND JURISDICTION

In case of dispute, these conditions of sale are governed by Italian law.

For the resolution of any disputes, the parties may submit to the courts and tribunals with jurisdiction in Milan, renouncing any other jurisdiction that may correspond to them.

 

ALTERNATIVE DISPUTE RESOLUTION

All consumers who have encountered problems with an online purchase that could not be resolved directly with the selling company can turn to the new online dispute resolution (ODR) platform prepared by the European Commission.
Alternative Dispute Resolution (
ADR) offers consumers and businesses the possibility to resolve their disputes out-of-court, quickly and inexpensively. In addition, by resorting to such mechanisms, the number of pending cases decreases and the ordinary justice system is decongested. A procedure for alternative dispute resolution is usually concluded within a few months and for the consumer the costs of the procedure tend to be lower than the legal ones.

How does the service work? ADR entities operate on an out-of-court basis and will be able to:

a. Help the parties seek agreement, but do not take a formal position on which solution, if any, to give to the dispute;

b. propose a solution to the parties (which in some cases may be binding)

c. acting as an "arbitrator", i.e., making a binding decision to resolve the dispute.

The platform - having verified the requirements established by law (Reg. Eu 524/2013, Reg. of execution 1051/2015, as well as ADR Directive 11/2013 and D. Lgs 130/2015) - will contact the seller and propose you to resolve the dispute out of court through an alternative dispute resolution body, the cd. ADR body (from the English "Alternative Dispute Resolution"). This will have to help you solve the problem within 90 days - extendable in exceptional cases.

The European Commission gives consumers the possibility to resolve disputes online, according to Art. 14 Par. 1 of the Online Dispute Resolution (ODR) on one of its platforms.
